duo cum faciunt idem, non est saepe idem [kum ídem, nón sé- ídem; lat.] — keď dvaja robia to isté, nie je to často to isté. Názor, že rovnaké konanie treba posudzovať odlišne podľa jeho pôvodcu, sa objavuje už u Terentia (Bratia, 823. verš): duo quom idem faciunt, saepe ut possis dicere – hoc licet inpune facere huic, illi non licet (keď dvaja robia to isté, mohol by si často povedať – jeden môže toto robiť beztrestne, druhý nemôže).
